Secondo quanto previsto dall'art. VI, paragrafo 4, della
convenzione sulle regole internazionali per prevenire gli abbordi in
mare (la cui ratifica fu autorizzata con legge 27 dicembre 1977, n.
1085, pubblicata nella Gazzetta Ufficiale n. 48 del 17 febbraio
1978), si comunica l'entrata in vigore per l'Italia dal 4 novembre
1995 della risoluzione A736 (18), adottata il 4 novembre 1993,
concernente gli emendamenti al regolamento internazionale del 1972.
Si riporta qui di seguito, in lingua inglese con traduzione non
ufficiale in lingua italiana il testo dell'atto sunnominato:

AMENDMENTS TO THE INTERNATIONAL REGULATIONS
FOR PREVENTING COLLISIONS AT SEA, 1972
THE ASSEMBLY,
RECALLING article VI of the Convention on the International
Regulations for Preventing Collisions at Sea, 1972, on amendments to
the Regulations,
HAVING CONSIDERED the amendments to the International Regulations
for Preventing Collisions at Sea, 1972, adopted by the Maritime
Safety Committee at its sixtyfirst session and communicated to all
Contracting Parties in accordance with paragraph 2 of article VI of
that Convention and also the recommendations of the Maritime Safety
Committee concerning entry into force of these amendments,
1. ADOPTS, in accordance with paragraph 3 of article VI of the
Convention, the amendments set out in the Annex to the present
resolution;
2. DECIDES, in accordance with paragraph 4 of article VI of the
Convention, that the amendments shall enter into force on 4 November
1995 unless by 4 May 1994 more than one third of the Contracting
Parties have notified their objection to the amendments;
3. REQUESTS the Secretary-General, in conformity vith paragraph 3
of article VI, to communicate this resolution to all Contracting
Parties to the Convention for acceptance;
4. INVITES Contracting Parties to notify any objections to the
amendments not later than 4 May 1994, whereafter the amendments will
be deemed to have been accepted to enter into force as determined in
the present resolution.
ANNEX
AMENDMENTS TO THE INTERNATIONAL REGULATIONS
FOR PREVENTING COLLISIONS AT SEA, 1972
1 Rule 26 (b) (i): Delete the words "a vessel of less than 20
metres in length may instead of this shape exhibit a basket".
2 Rule 26 (c) (i): Delete the words "a vessel of less than 20
metres in length may instead of this shape exhibit a basket".
3 Rule 26 (d): is amended to read as follows: "(d) The additional
signals described in Annex II to these regulations apply to a vessel
engaged in fishing in close proximity to other vessels engaged in
fishing".
4 Annex I, section 3 - Horizontal positioning and spacing of
lights: a new paragraph (d) is added as follows: "(d) When only one
masthead light is prescribed for a power driven vessel, this light
shall be exhibited forward of amidships; except that a vessel of less
than 20 metres in length need not exhibit this light forward of
amidships but shall exhibit it as far forward as is practicable".
5 Annex I, section 9 - Horizontal sectors: - the existing paragraph
"(b)" is renumbered to read "(b) (i)". - a new subparagraph (b) (ii)
is added as follows:
"(b) (ii) If it is impracticable to comply with paragraph (b) (i)
of this section by exhibiting only one allround light, two allround
lights shall be used suitably positioned or screened so that they
appear, as far as practicable, as one light at a distance of one
mile".
5 Annex I, section 13 - Approval: Amend to read "14. Approval"; and
insert a new section 13 as follows: "13. High speed craft
The masthead light of high apeed craft with a length to breadth
ratio of less than 3.0 may be placed at a height related to the
breadth of the craft lower than that prescribed in paragraph 2 (a)
(i) of this annex, provided that the base angle of the isosceles
triangles formed by the sidelights and masthead light, when seen in
end elevation, is not less than 27 ".
7 Annex II, section 2 - Signals for trawlers: - the leadin sentence
of paragraph (a) is amended to read: "(a) Vessels of 20 metres or
more in length when engaged in trawling, whether using demersal or
pelagic gear, shall exhibit;" - the leadin sentence of paragraph (b)
is amended to read: "(b) Each vessel of 20 metres or more in length
engaged in pair trawling shall exhibit:" - a new paragraph (c) is
added as follows: "(c) A vessel of less than 20 metres in length
engaged in trawling, whether using demersal or pelagic gear or
engaged in pair trawling, may exhibit the lights prescribed in
paragraphs (a) or (b) of this section, as appropriate".
8 Annex IV, subparagraph 1 (o): Amend to read: "1 (o) approved
signals transmitted by radiocommunication systems, including survival
craft radar transponders".

EMENDAMENTI AL REGOLAMENTO INTERNAZIONALE
DEL 1972 PER PREVENIRE GLI ABBORDI IN MARE
L'Assemblea,
ricordando le disposizioni dell'Art. VI della Convenzione sul
Regolamento internazionale del 1972 per prevenire gli abbordi in mare
che si riferiscono agli emendamenti da apportare a questo
Regolamento;
avendo esaminato gli altri emendamenti al Regolamento
internazionale del 1972 per prevenire gli abbordi in mare che il
Comitato della sicurezza marittima ha adottato durante la sua
sessantunesima sessione e che sono stati comunicati a tutte le Parti
contraenti conformemente alle disposizioni del paragrafo 2 dell'art.
VI della predetta Convenzione, nonche' le raccomandazioni fatte dal
Comitato della sicurezza marittima relative all'entrata in vigore di
questi emendamenti,
1. Adotta, conformemente al paragrafo 3 dell'art. VI della
Convenzione, gli emendamenti che figurano in allegato alla presente
risoluzione;
2. Decide, conformemente al paragrafo 4 dell'art. VI della
Convenzione, che ogni emendamento entrera' in vigore il 4 novembre
1995, a meno che entro il 4 maggio 1994 piu' di un terzo delle Parti
contraenti non abbiano notificato la loro opposizione agli
emendamenti;
3. Prega il Segretario Generale, conformemente a quanto contenuto
nel paragrafo 3 dell'art. VI, di comunicare la presente risoluzione a
tutte le Parti contraenti la Convenzione per l'approvazione;
4. Invita le Parti contraenti a sottoporre le loro obiezioni agli
emendamenti al piu' tardi il 4 maggio 1994, data dopo la quale gli
emendamenti saranno considerati come entrati in vigore, conformemente
alle disposizioni di questa risoluzione.
ANNESSO
EMENDAMENTI AL REGOLAMENTO INTERNAZIONALE
DEL 1972 PER PREVENIRE GLI ABBORDI IN MARE
1. Regola 26 (b) (i) Cancellare le parole: "una nave di lunghezza
inferiore a 20 metri invece di questo segnale puo' mostrare un
cesto".
2. Regola 26 (c) (i) Cancellare le parole: "una nave di lunghezza
inferiore a 20 metri invece di questo segnale puo' mostrare un
cesto".
3. Regola 26 (d) Modificare questa regola come segue: "(d) I
segnali supplementari descritti nell'Annesso II al presente
Regolamento si applicano ad una nave che sta pescando a breve
distanza da altre navi che stanno pescando".
4. Annesso I, Sezione 3. Sistemazione e distanze dei fanali sul
piano orizzontale. Aggiungere un nuovo paragrafo (d) come segue: "(d)
Quando per una nave a propulsione meccanica e' prescritto un solo
fanale di testa d'albero, questo fanale deve trovarsi a proravia del
centro della nave; se invece si tratta di una nave di lunghezza
inferiore a 20 metri questo fanale non deve essere posto a proravia
del centro della nave bensi' quanto piu' a proravia sia praticamente
possibile".
5. Annesso I. Sezione 9. Settori orizzontali di visibilita'. -
Rinumerare il paragrafo (b) come "(b) (i)". - Aggiungere il nuovo
paragrafo (b) (ii) come segue: "(b) (ii) Se e' impossibile
ottemperare nella pratica al paragrafo (b) (i) della presente Sezione
esibendo un solo fanale visibile su tutto l'orizzonte, devono essere
utilizzati due fanali visibili su tutto l'orizzonte e
convenientemente sistemati o oscurati in modo da apparire, per quanto
possibile, come un unico fanale da una distanza di un miglio".
6. Annesso I, Sezione 13. Approvazione. - Rinumerare questa Sezione
in modo che diventi "14. Ap provazione". - Inserire una nuova Sezione
13 come segue: "13. Mezzi navali ad alta velocita'.Il fanale di testa
d'albero per i mezzi navali ad alta velocita' il cui rapporto
lunghezza/larghezza e' inferiore a 3.0 puo' essere sistemato ad
un'altezza che, in relazione alla lunghezza dello scafo, e' inferiore
a quella prescritta alla Sezione 2 (a) (i) del presente Annesso, a
condizione che l'angolo alla base del triangolo isoscele formato dal
fanale di testa d'albero ed i fanali laterali, visti di fronte, non
sia minore di 27 gradi".
7. Annesso II, Sezione 2. Segnali per pescherecci con reti a
strascico. - Modificare come segue la frase introduttiva del
paragrafo (a): "Le navi di lunghezza uguale o superiore a 20 metri
intente a pescare con reti a strascico sia che usino attrezzi di
fondo o reti pelagiche devono mostrare:" - Modificare come segue la
frase introduttiva del paragrafo (b): "Tutte le navi di lunghezza
uguale o superiore a 20 metri intente in operazioni di pesca a
strascico in coppia devono mostrare:" - Aggiungere un nuovo paragrafo
(c) come segue: "(c) Una nave di lunghezza inferiore a 20 metri
intenta a pescare con reti a strascico sia che usi attrezzi di fondo
o reti pelagiche o intenta ad operazioni di pesca a strascico in
coppia, puo' mostrare i fanali prescritti al paragrafo (a) o (b) di
questa Sezione secondo il caso".
8. Annesso IV. Segnali di pericolo. - Modificare come segue il
paragrafo (1) (o): "1 (o) segnali approvati trasmessi da sistemi di
radiocomunicazione, compresi i risponditori radar dei mezzi di
salvataggio".
